Amendments to the Fair Work Act have introduced significant changes to Australia's enterprise bargaining regime. We are now seeing these new provisions considered and applied by the Fair Work Commission and an evolving response from the union movement.
Whilst elements of the changes were intended to encourage more employers to engage in enterprise agreement making and to simplify the approval process, the amendments have also created challenges and risks for employers trying to plan and manage their bargaining. For many, the new environment will warrant a changed approach to bargaining.
