On 25 March 2025, the Government announced it would ban non-compete clauses for workers earning less than the high-income threshold, which is currently $183,100.

This change would prevent an employer stopping a worker from working or being involved with a competing organisation after they cease working for that employer.

On 25 July 2025, the Australian Treasury released a consultation paper seeking feedback on the implementation of the ban. The Treasury is also seeking feedback on whether it will make further changes, including restricting or banning non‑solicitation clauses for all workers and extending the ban on non‑compete clauses to high‑income workers.

The closing date for submissions is 5 September 2025.
