On 2 April 2026, an application was made by the Transport Workers' Union and the Australian Road Transport Industrial Organisation for a road transport contractual chain order pursuant to s.536PE of the Fair Work Act 2009. On 7 April, in accordance with a statement issued by Justice Hatcher, Australian Industry Group made submissions. Amongst other matters, we argue we should be afforded a reasonable opportunity to consider all the issues, and present submissions and evidence upon which we seek to rely, before the Commission makes a decision as to whether it will issue a notice of intent and draft road transport contractual chain order.
