The Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 made various changes to the Fair Work Act 2009 (Cth) including changes to the way in which the better off overall test is applied by the Fair Work Commission (FWC) in its consideration of applications to approve enterprise agreements. These particular changes apply to enterprise agreements made on or after 6 June 2023.
The Fair Work Legislation Amendment (Closing Loopholes No.2) Act 2024 changed the way in which the better off overall test is applied in circumstances where the FWC is asked to approve a new single interest agreement to cover at least one employee to whom an existing single interest employer agreement or supported bargaining agreement applies. These particular changes apply to single-enterprise agreements made on or after 27 February 2024.
