Amendments to the Fair Work Act have introduced significant changes to Australia’s enterprise bargaining regime. We are now seeing these new provisions considered and applied by the Fair Work Commission and an evolving response from the union movement.

Whilst elements of the changes were intended to encourage more employers to engage in enterprise agreement making and to simplify the approval process, the amendments have also created challenges and risks for employers trying to plan and manage their bargaining. For many, the new environment will warrant a changed approach to bargaining.

The purpose of the sessions will be to assist employers to prepare for enterprise bargaining with unions and/or their workforce by providing an explanation and update on matters including:

  • The key bargaining related changes introduced through the amendments to Fair Work Act 2009 and related practical and strategic considerations for employers.
  • An update on Fair Work Commission bargaining related decisions and proceedings of significance to industry; and
  • An overview of recent bargaining and wage outcomes, as well as key union claims and agendas.

The two-hour briefing will include a presentation from our experts in bargaining, as well as an opportunity for members to share their experiences of the current bargaining environment.
