This Member Advice provides information about the status of legislation that relates to psychosocial risks at work. It replaces Member Advice NAT 013/25, dated 9 April 2025.

The model WHS Regulations and model Code of Practice for psychosocial risks were published in 2022. The model Code of Practice for sexual and gender-based harassment was published in February 2024. All jurisdictions except Victoria have adopted the regulations, with amendments in some jurisdictions.

This Advice includes information about the adoption, or otherwise, of codes of practice, and an overview of other laws that relate to one of the key psychosocial hazards – sexual harassment and hostile workplaces.

This Member Advice has been updated to reflect that Victoria have now made their Occupational Health and Safety (Psychological Health) Regulations. The regulations, supported by a compliance code, will become effective on 1 December 2025.

It is important that organisations consider how all the psychosocial risks combine and interact, and then take a holistic approach to eliminating or minimising risk. The focus should be on work design and workplace design in consultation with workers, supported by appropriate policies and training as needed.
