On 3 October 2025, the Australian Industry Group filed a submission concerning the following questions posed by the Fair Work Commission in its statement issued on 21 August 2025, regarding the model right to disconnect term in modern awards (Model Term):

• Whether it is necessary to conduct a review of the Model Term, either generally or in respect of specific awards, at this point in time, and if so, what aspects of it.
• Whether the Fair Work Commission should now make guidelines, ‘noting the lack of any guiding case authority at this point’.
