Under the Fair Work Act 2009 (Cth), employers are prohibited from engaging an employee under a fixed term contract that continues for more than two years, or from entering into more than two successive fixed term contracts with the same employee for substantially similar work.

The Fair Work Regulations 2009 (Cth) provides for exceptions to these limitations.

The Government recently registered the Fair Work Amendment (Fixed Term Contracts) Regulations 2025 which made a small number of changes to these exceptions.
