On 3 November 2025 the Fair Work Amendment (Baby Priya's) Bill 2025 passed Parliament.
The Bill amends the Fair Work Act 2009 (Cth) to provide that, unless employers and employees have expressly agreed otherwise, employer-funded paid parental leave must not be cancelled or refused because a child is stillborn or dies.
The new prohibition only applies to paid leave that an employee is entitled to under their terms and conditions of employment.
The changes will commence the day after Royal Assent.
