Victimisation occurs when a person subjects, or threatens to subject, another person to some type of detriment because they have lodged a complaint, or has provided evidence or information about a complaint. Victimisation is prohibited under state and federal anti-discrimination legislation. Victimisation is both a civil and criminal offence, and penalties include potential imprisonment under federal anti-discrimination legislation. Victimisation will also constitute adverse action under the Fair Work Act’s general protections regime.
