Australian Industry Group welcomed the opportunity to provide feedback on the draft legislation on Minimum tax on discretionary trusts which comprises part of the broader package of capital gains tax (CGT) reform package introduced in the 2026-27 Federal Budget.
 
We made this submission in the context of our prior submission to the initial consultations which were conducted by Treasury in July this year. We welcome that the draft legislation has recognised these concerns, and in large part implemented our recommendations via the introduction of new mechanisms.
 
We commend the government for adopting these mechanisms in response to industry feedback. Together, they will obviate the need for many entities to engage in restructuring via the EET mechanism, and provide greater simplicity and flexibility for those which choose to restructure.
 
However, additional implementation issues have arisen in the draft legislation which require further attention. These are as follows:
