The Transport Workers' Union's (TWU) application for a road transport minimum standards order (RTMSO) for road transport contractors performing light vehicle delivery work has been the subject of a partly conducted hearing before an Expert Panel of the Fair Work Commission (FWC) that had been scheduled from 22 July to 7 August 2026.

The purpose of the hearing was to consider whether the FWC should issue a Notice of Intent to make an RTMSO in the terms proposed by the TWU on 27 May 2026 (TWU Draft RTMSO), or an alternative form of RTMSO proposed by other interested parties.

On 6 August 2026, the TWU and another employer organisation filed an alternative form of RTMSO for light vehicle delivery work (Alternate RTMSO). The partially conducted hearing has accordingly been vacated and a new timetable for the matter has been set in light of the new claim.

Interested parties now have until 21 August 2026 to file material in reply to the Alternate RTMSO.

Australian Industry Group is now urgently seeking members' comments and feedback on the Alternate RTMSO in order to inform our submissions and advocacy in relation to this development.

Although a number of matters that we objected to in the TWU's initial claim have been addressed in the Alternate RTMSO, we have not consented to the Alternate RTMSO and have significant concerns about elements of its content.
